1. Nature of the Agreement

1.1. These Terms govern the Mobile Repair & Maintenance Service Plans (“Plans”) offered by [Your Company Name] (“Company”).

1.2. This is a Service Contract under the Indian Contract Act, 1872.

1.3. This is NOT an insurance product, does not involve risk transfer, and is not regulated by IRDAI.

1.4. The Company provides repair service, technical support, or part replacement strictly as per the purchased plan.

1.5. No monetary compensation, refund, cash reimbursement, or indemnity will be provided.

2. Eligibility

2.1. The plan applies only to the device whose IMEI and details were submitted at the time of purchase.

2.2. Any IMEI mismatch, tampering, or misrepresentation may result in cancellation of the plan.

3. General Exclusions (Applicable to All Plans)

The following are not covered under any plan:

• Theft or loss

• Customer negligence

• Unauthorized repairs

• Pre-existing damage

• Damage before plan activation

• Illegal modifications

• Data loss or software corruption

• Cosmetic issues, dents, scratches, or wear & tear

4. Customer Obligations

4.1. The customer must provide accurate device information.

4.2. Data backup is the customer’s responsibility.

4.3. The customer must disable screen locks or share access for testing.

4.4. The correct cause of damage must be disclosed.

4.5. Service requests must be reported within 72 hours of the incident.

4.6. Co-payment Obligation (Flexible Clause)

  • • The customer may be required to pay a co-payment for repair services.The exact co-payment (amount/percentage) will be mentioned in the Plan Details Sheet/Sales Receipt and may vary by plan.Co-payment is strictly non-refundable.

5. Service Limits & Liability

5.1 Economic Repair Rule

The Company will perform repair only if it is economically feasible.

5.2 Parts Availability

If original parts are unavailable, the Company may use compatible or refurbished parts.

5.3 ⭐ Maximum Cumulative Liability (100% Device Value Cap)

  • The total cumulative expenditure incurred by the Companyfor all repairs combined (including parts and labor)shall never exceed the original purchase price of the device.
  • Once this limit is reached, the contract will terminate automatically,and further repair services will be fully chargeable to the customer.

5.4 Delays

The Company is not liable for delays due to part shortages or supplier issues.

5.5 Repair Timeline

Repairs typically take 15–21 business days, depending on parts availability.

5.6 Obsolete Device Policy

If the device model becomes obsolete and parts are unavailable,the Company may terminate the contract and offer a pro-rata refund.

5.7 Unlimited Repairs Clarification

Unlimited repairs are allowed only until the cumulative repair limit (100% of the device’s value) is reached.

6. Fraud & Misrepresentation

Any fraud, misrepresentation, or concealment of damage cause will result in immediate termination of the plan.

7. Governing Law

These Terms shall be governed by the Indian Contract Act, 1872.All disputes fall under the exclusive jurisdiction of courts in Delhi, India.
